These Terms & Conditions ("Terms") govern your use of the Wailore website and app (the "Service"), operated by Aaron Rosenthal ("we", "us", "our"). By accessing or using the Service you agree to these Terms.

1. Who you are contracting with

The Service is provided by Aaron Rosenthal, a sole trader. If you are using the Service on behalf of an organisation, you confirm you have authority to bind it. If you are using the Service as an individual, you confirm you are of legal age in your jurisdiction.

2. The Service

Wailore generates AI-narrated audio tours of places near you using data from Wikipedia, Google Maps, and third-party AI models. The Service is provided on an "as is" and "as available" basis. We do not guarantee that narration is complete, accurate, or free of errors.

3. Acceptable use

You agree not to:

  • Use the Service for any unlawful purpose or to infringe another person's rights;
  • Attempt to interfere with, probe, scrape, or reverse-engineer the Service;
  • Transmit malware, spam, or fraudulent content through the Service;
  • Use the Service in a way that endangers you or others (e.g. distracted driving — always follow local road-safety laws);
  • Resell, redistribute, or sublicense the Service or its outputs.

4. Accounts

You are responsible for keeping your account credentials confidential and for any activity that happens under your account. Provide accurate information and keep it up to date.

5. Intellectual property

The Service, including its software, design, and branding, is owned by Aaron Rosenthal and protected by intellectual-property law. We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with these Terms. Third-party content surfaced in the Service (e.g. Wikipedia article excerpts, Google Maps data) remains the property of its respective owners.

6. AI-generated content

Narration is generated by AI models and may contain inaccuracies. You are responsible for how you use the outputs, and outputs should not be relied on for professional, legal, medical, or safety-critical advice. We may filter, moderate, or refuse outputs at our discretion.

7. Payment, subscription, and refunds

Payments for Wailore Premium are handled by our reseller Paddle. Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellation, and refund mechanics are governed by Paddle's Buyer Terms. See also our Refund Policy.

8. Suspension and termination

We may suspend or terminate your access to the Service for material breach of these Terms, non-payment, security or fraud risk, or repeated or serious policy violations. You may stop using the Service at any time.

9. Warranties and liability

To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose. Our aggregate liability for any claim arising out of or relating to the Service is capped at the fees you paid to us in the twelve (12) months before the claim. We exclude liability for indirect, consequential, or special damages (including lost profits, data, or goodwill). Nothing in these Terms limits liability for fraud, death, or personal injury caused by negligence where such limitation is prohibited by law.

10. Indemnity

You agree to indemnify us against claims arising from your misuse of the Service or violation of these Terms.

11. Changes

We may update these Terms from time to time. Material changes will be notified via the Service or by email where possible.

12. Governing law

These Terms are governed by the laws of the jurisdiction in which Aaron Rosenthal resides, without regard to its conflict-of-laws rules.
